CONSTITUTION OF AMAWBIA YOUTH VANGUARD

ARTICLE 1:       NAME AND TITLE

The Organization shall be called Amawbia Youth Vanguard here in after referred to as AYV or simply the “Vanguard”.

 

ARTICLE 2:       MOTTO

Restore the Integrity of Amawbia

 

ARTICLE 3: OFFICE ADDRESS/APPLICATION

  • OFFICE AND ADDRESS

The Registered Office and Address of the Vanguard shall be

ATU Secretariat. Eziokpaligwe square Amawbia

 

  • APPLICATION

This constitution shall apply to all Amawbia Citizen at home and abroad where this Constitution conflict with the constitution of Amawbia Town Union. The later shall prevail.

 

ARTICLE 4. AIMS AND OBJECTIVES/FUNCTION

  • AIMSS AND OBJECTIVES

The aims and objectives of Amawbia Youth Vangurad which  shall be non-political and non-religious are to protect. Defend and promote the interest of all indigenes and non-indigens living in Amawbia through the attainment of the following objectives.

  1. To  co-operate and collaborate with Amawbia Town Union Government
  2. To uphold and protect the constitution of Amawbia Town Union.
  • To fight crime in Amawbia Community.
  1. To defend the territorial of Amawbia Autonomous Community.
  2. To mobilize and galvanize the Youth in Amawbia into a cohesive group for development of Amawbia Community
  3. To undertake social and economic activities for upliftment of the youth and entire Amawbia Community.
  • To provide a central point for the discussion of matter affecting Amawbia youth.

 

2       FUNCTION

  The vanguard shall be an organ of Amawbia Town Union (ATU) and assist in ensuring discipline orderliness and peace in Amawbia.

i      To execute tasks and other legitimate functions ASSIGNED TO IT by the President General or the Central Council of ATU.

ii     To settle dispute between members and encourage love, brotherliness and peaceful coexistence among members and villages.

iii    To helps or encourage the implement of ATU policies

iv    To encourage Amawbia Youth to be useful and productive that will make them an asset in any community they find themselves.

 

ARTICLE 5A      MEMBERSHIP

The membership of the vanguard shall be open to all youths who are indigenes of Amawbia. Nwadians, and other youth resided in Amawbia and vouched to be good of character.

 

5B    REGISTRATION OF MEMBERSHIP

An eligible candidate shall be registered as a member as a member on payment of Registration fee of N100.00 to financial secretary of the vanguard.

 

ASSOCIATESHIP

Any Village Youth group which has registered with the vanguard and ATU who are pursuing the same goal as the vanguard are eligible to be made Associates.

 

5C  MEETINGS

There shall be from time to time the following types of meetings

  • General meetings
  • Executive meetings
  • Emergency  General meetings
  • Emergency Central youth meetings

 

The general meting shall be the major main meeting where all matters affecting the vanguard shall be deliberated upon and shall always be holding on a date to be decided or chosen by the CYC while other meeting shall hold at any time depending on the emergency of the time.

 

  • QUORUM FOR GENERAL MEETING:

The quorum at the General meeting shall be 15members which shall include chairman or his vice, the secretary, the director of social and at least one from each of three villages.

 

It shall be necessary for the quorum to be formed in emergency general meeting with at least to 10 members. Decisions reached at a properly constituted emergency meeting and general meeting shall be decision of the vanguard.

 

  1. ATTENDANCE TO MEETINGS:
  2. Attendance to general meeting is mandatory to all elected officers and accredited representatives of the villages where the chairman can not attend his deputy shall represent him.
  3. Lateness to general meeting without cogent reason shall attract a fine of twenty naira (N20.00).

iii.   A member who absents himself from the general meetings without cogent reason in writing is liable to a fine of fifty naira (N50.00).

  1. Any member who deliberately disturbs the normal proceeding of the meeting shall be liable to a fine of five hundred naira (N500.00).
  2. Any member who fight during the normal proceeding of the meeting shall be suspended and pay a fine of One Thousand Naira (N1, 000).

 

  1. SUMMONING OF MEETINGS

It shall be the duty of the secretary to summon general meeting. Emergency executive meeting, emergency general meeting and central youth council meetings on the instruction of the chairman.

 

Meeting shall be summoned by means of Circulars. Notice send to every member, by the gangman, Radio or Television announcement.

 

ARTICLE 6.       AMAWBIA YOUTH VANGUARD

                        ORGANISATION AND COMPOSITION

The vanguard shall be composed of two organs to purse the aims and objectives set-out in Article 4 of the Constitution

  1. The General Assemble (G.A)
  2. Central Youth Council (C.Y.C)

 

ARTICLE 7.       GENERAL ASSEMBLE (G.A)

  • COMPOSITION:

The General Assemble shall be composed of the following:

  • Three (3) accredited delegates from each of the six villages of Amawbia Town
  • All members of the Central Youth Council
  • All youth members of the town starting from eighteen years and above.

 

2      POWERS:

(i)       The General Assemble shall have authority over all matters concerning the Youth in the town. But the decision of the ATU shall be final.

(ii)     It shall delegate power and responsibilities to the central Youth Council or Ad-hoc standing committees that may be appointed.

(iii)     The General Assemble shall receive. Consider and take decision on appeals from any officer, or member (Youth) against any disciplinary action previously taken by any organ of the Amawbia Youth Vanguard.

 

 

3      FUNCTIONS:-

        The General Assemble shall:-

  • Receive and debate president (Chairman’s address).
  • Receive and debate detailed reports by the Central Youth Council on its work during the year and use them as basic for discussion and formulation of policies.
  • Receive report set up by the Central Youth Council when occasion demands.
  • Deliberate on motions submitted by any indigene of Amawbia Town and non-indigene residing within Amawbia Territory and endorse such motions with or without amendment or reject them.
  • Amend and adopt the constitution in accordance with laid down procedures.
  • Elect and appoint officers of the Amawbia Youth Vanguard through the approval of ATU.

 

ARTICLE 8: CENTRAL YOUTH COUNCIL (C.Y.C.)

(1)     COMPOSITION

The Central Youth Council shall be composed of:-

  • All the Elected Officers
  • All the appointed officers
  • All the co-opted members as may be recommended by the Central Youth council.
  • Two Representatives each of the six Villages
  • All the past Chairman of AYV.

 

(2)     POWERS:

The Central Youth Council shall have authority to

  • Direct the activities of the Amawbia Youth Vanguard during its tenure of office.
  • Appoint Ad-hoc or Standing Committee of the Amawbia Youth Vanguard subject to rectification by the General Assemble.
  • Discipline any member of the Amawbia Youth Vanguard whose misconduct is established.
  • Raise fund for any purpose and if necessary impose levy on members of Amawbia Youth Vanguard.
  • Invest and administer the funds of Amawbia Youth Vanguard and grant financial assistance to any organization in Nigeria in accordance with the constitutional provisions or directives of the General Assemble.
  • Recommend to the General Assembly the suspension or termination of the membership of Amawbia Youth Vanguard, on advise of the Disciplinary Committee under the Chairmanship of the President for any misconduct which is inimical to the over all interest of the Amawbia Youth Vanguard after a fair enquiry.

 

(3)     FUNCTIONS

The Central Youth Council shall:-

  • Execute the policies and decisions of the General Assemble.
  • Endeavour to settle disputes and differences between members when reported officially to the Amawbia Youth Vanguard.
  • Prepare on the basis of Committees’ report, a comprehensive report on the entire activities of the Vanguard for presentation to the General Assemble.
  • Fill any vacant elective or appointive office on acting capacity pending ratification by the General Assemble.

 

(4)     MEETING

The Central Youth Council shall meet at least once every week, being (Saturday of every week).

 

(5)     QUORUM

The quorum of the Central Youth Council meeting shall be ten (10) of its members.

 

ARTICLE 9:       OFFICERS OF THE AMAWBIA YOUTH VANGUARD

The Principal Officers of the Amawbia Youth Vanguard shall be:-

  • President (Chairman)
  • Vice President (Vice Chairman)
  • Secretary – General I
  • Secretary General II
  • Treasurer
  • Financial Secretary
  • Public Relation Officer I
  • Public Relation Officer II
  • Director of Social I
  • Director of Social II
  • Provost I
  • Provost II
  • 6 Trustees each from the six villages
  • Patrons/Matrons
  • A legal Officer

 

ARTICLE 10:     DUTIES OF THE OFFICERS

(1)     CHAIRMAN

The duties of the Chairman shall include among others

  • To summon general, executive and emergency meetings if need be by directing the Secretary General.
  • To preside over all meetings of the Vanguard.
  • To approve and/or authorize any expenditure by the Vanguard.
  • To rule on any issue or matter sufficiently deliberated upon by the members.
  • To issue and sign documents on behalf of the Vanguard.
  • To sign all minutes of meetings when approved, shall be responsible for the proper conduct of the meeting proceedings.
  • To do any other duties incidental to the above stated duties or as may be directed by the President General, ATU Central Council and Okpaligwe Amawbia.

 

(2)     VICE-CHAIRMAN

The duties of the Vice Chairman shall be:-

(i)       To assist the Chairman

(ii)      To perform all the duties of the Chairman in his absence.

 

(3)     SECRETARY GENERAL I

The Secretary General shall perform the following duties:-

  • To perform all Secretarial duties of the Vanguard.
  • To be the custodian of all documents of Vanguard.
  • To summon general, executive and emergency meetings at the instruction of the Chairman and prepare agenda for such meeting.
  • To maintain proper record and custody of all property of the Vanguard.
  • Shall prepare an annual report of activities of the Vanguard.
  • He shall maintain an accurate and up-to-date record of all Amawbia Youth and their addresses in separate official register for each village.
  • To take minute of meetings and shall on adoption sign such document jointly with the Chairman.
  • To perform all duties incidented to the above state duties and or as may be directed by the Chairman from time to time.

 

(4)     SECRETARY-GENERAL II

The Secretary-General II shall assist the Secretary-General I and perform such duties as may be assigned to him by the Secretary-General I or the Central Youth Council. He shall act in the absence of the Secretary-General I. also to act as the secretary of committee as may be directed by the central youth council

 

(5)     TREASURER

He shall perform the following functions:

  • To receive all monies of the Vanguard from the Financial Secretary and pay same to the Vanguard’s bank account within 48 hours of receipt. He shall issue official receipt to cover all monies received.
  • He shall keep an imprest account of not more than N5,000.00.
  • To keep an accurate and adequate records of all monies received and disbursed and shall keep the bank pass and cheque books.
  • To surrender or make available all financial records of the Vanguard in his possession to the auditors when requested.
  • He shall render financial reports to the general meeting as may be required from time to time.

 

(6)     FINANCIAL SECRETARY

(i)       He shall receive on behalf of the Vanguard all the monies due to the Vanguard and maintain an accurate and up-to-date account of such monies received.

(ii)      He shall pay all monies received to the Treasurer not less than twenty four (24) hours after such monies are received and shall obtain an official receipt from the Treasurer for such payments.

(iii)     He shall prepare all payment vouchers and keep duplicate of such paid vouchers.

(iv)     He shall maintain a register of all payments.

(v)      To make available all books of account and records in his possession to the auditors when required.

 

(7)     PUBLIC RELATION OFFICER 1(PRO)

He shall be charged with the responsibility of publicizing the activities of the Amawbia Youth Vanguard. He shall ensure the good public image of the Amawbia Youth Vanguard. He shall work closely with the President and Secretary General in order to ensure good flow of information to entire member. No press release shall be issued or publication made without the prior approval/permission of the Central Youth Council. The such releases/ publication must be voted and endorsed by the President and a copy lodged with the Secretary in advance and office of the President.

 

(8)     PUBLIC RELATION OFFICER II

To assist the Public Relation Officer I in discharging all the duties of Public Relation Officer I mentioned above. He shall distribute circulars, letters and other information materials as directed to those concerned.

 

(9)     DIRECTOR OF SOCIAL I

He shall act as the Protocol Officer of the Amawbia Youth Vanguard.

He shall be responsible for the arrangement of venues as may be directed by the Central Youth Council. He shall organize social functions of the Amawbia Youth Vanguard and ensure good welfare of all members at meetings and ceremonies. He shall allocate seats to members according to merit.

 

 

 

(10)   DIRECTOR OF SOCIAL II

He shall assist the Director of Social I in discharging his duties and shall act full in the absence of the Director of Social I.

 

(11)   PROVOSTS

They shall act as the Police Force of both the Central Youth Council meeting and General Assemble to maintain law and order in the meeting.

 

(12)   TRUSTEES

The six (6) persons who shall be appointed Trustees shall be of high integrity with proven records of commitments and contributions (in cash and kind) to the Welfare and Progress of Amawbia Youth Vanguard. They shall be appointed by the Central Youth Council and confirmed by the General Assemble on their individual merits only. The trustrees shall ensure the security of the properties of Amawbia Youth Vanguard and shall upon dissolution of the Amawbia Youth Vanguard for any of reason take immediate charge of the founds and properties of the Amawbia Youth Vanguard. The Trustees shall give constructive advice to the Amawbia Youth Vanguard officers and assist the Vanguard morally and financially.

 

(13)   PATRONS

The Patrons shall be appointed by the Central Youth Council and Confirmed by the General Assemblies on their individual merits only. They shall be persons of exemplary character who shall inspire the Youth Vanguard to great achievements. They shall give constructive advice to the Youth Vanguard and generally offer mature guidance to the officers of the Youth Vanguard. They shall be the “Fathers” of the Amawbia Youth Vanguard and finally cannot be residing away from one hundred kilometer (100 kilometers) from Amawbia Town.

 

(14)   LEGAL OFFICER

The Legal Officer should be appointed to carry out the duties that involve legal proceeding and to act as solicitor  to the Vanguard.

 

ARTICLE 11:     ELECTION

  • Election of officers of the Amawbia Youth shall be at the General Meeting.
  • The election shall be by secret-ballot.
  • The election shall be conducted by a committee to be known as the returning officers.
  • The Committee shall be appointed by the General Assemble summoned for the election.
  • The election which must be free and fair shall be conducted in such a manner as to ensure geographical spread of the officers to ensure adequate participation and involvement of reasonable cross-section of members in the affairs of the Youth Vanguard.
  • Any other useful way not mention in the constitution but suggested by the returning officers or Central Youth Council shall get the approval of the General Meeting summoned for the election before application.

 

ARTICLE 12:     TENURE OF OFFICE

        The life span of the elective or appointive office shall be three (3) years.

Any officer of the dissolved Central Youth Council shall be eligible for re-election provided such an officer does not serve more than two (2) terms. In a situation where election could not be held at the expiration of the tenure of any Executive, only one month grace shall be allowed and after which the Executive stands dissolved. Thereafter the proper quorum of the Trustees shall over see the affairs of Vanguard and arrange/ conduct election and constitute/install a new Executive.

 

ARTICLE 13:     REMOVAL OF OFFICERS

OFFICER/OFFICERS shall be removed from office through, the following processes:-

  • By a written motion of vote of no confidence moved by a member of the Youth Vanguard and supported and signed by another. A 2/3 majority votes of members present at a properly constituted General Assemble must be passed. Such an officer must be informed in writing of his impending removal and be given a chance to defend himself.
  • By a motion or recommendation passed by the Central Youth Council on any officer or group of officers provided such a motion or recommendation received 2/3 majority vote of members present at a properly constituted General Assemble.

 

13B. CONDITION FOR REMOVAL

  • If the Officer involve commit a criminal offence.
  • If the Officer involve is incapable of doing his duties.
  • Dishonesty, when an officer is not honest to the Vanguard such an officer shall be removed from office.

 

ARTICLE 14:     QUALIFICATION FOR DELEGATES

To be represented at the Central Youth each member must have paid up their membership annual subscription and cleared outstanding levies if any.

 

Only accredited delegates of villages shall be admitted at the  Central Youth Council.

 

Where observers from the Town Union or Association are allowed to observe the proceeding of the meeting, they can be only allowed to contributed to a debate but shall not be allowed to vote on any issue or be voted for any post.

 

ARTICLE 15      SOURCES OF THE INCOME

(1)     The sources of the income of the Amawbia Youth Vanguard shall be from:

(a)      Membership registration fee of N100.00

(b)     Membership annual subscription fee N240 per member

(c)      Levies

(d)     Donations

(e)      Fines

(f)       Amawbia Youth Vanguard sales e.g. pamphlets. Almanacs and auction sales of the Amawbia Youth Vanguard properties.

(g)      Any other methods approved by the Central Youth Council.

(2)     CUSTODY OF THE PROPERTY OF THE AMAWBIA YOUTH VANGUARD

The custody of the properties of the Youth Vanguard shall be vested in hands of the trustees of the Amawbia Youth Vanguard.

 

(3)     SINGNATORY TO AMAWBIA YOUTH VANGARD ACCOUNTS

The signatories to the Youth Vanguard’s Bank Account shall be the President, the treasurer and the Financial Secretary. The President with any other shall sign.

 

(4)     BANKER

The Bankers of the Youth Vanguard shall be appointed by the  Central Youth Council and approved by the General Assemble.

 

(5)     INVESTMENT

The founds of the Amawbia Youth Vanguard shall be invested as may be directed by the General Assemble on the advice of the Central Youth Council.

 

(6)     AUDIT/ACCOUNTS

The books of account of the Amawbia Youth Vanguard shall be kept in line with simple accounting principles and shall be audited annually by internal Auditors appointed by the General Assemble. Three (3) months before the expiration of the tenure of the carried out. The General Meeting shall have power to appoint External Audits when deemed necessary or when occasion demands.

 

The Central Youth Financial  Secretary shall present to the General Assemble yearly financial reports and detailed statement of Accounts after any fund raising activities.

 

ARTICLE 16      MISAPPROPRIATION OF FUNDS/MISCONDUCT

(1)     MISUSE OF FUND

Any person or persons suspected by the Central Youth Council to have misappropriated the funds of the Amawbia Youth Vanguard shall be suspended forthwith and an investigation panel shall be set up to investigate the allegation. If the findings of the panel, as charged the person or persons  concerned shall be made to refund the funds.  The Central Youth Council shall spare no efforts and employ all legitimate means to recover the funds.

 

(2)     MISCONDUCT

Civil Offences: Any person found committing offence against the town shall be handed over to the appriate authority for further action.

 

Criminal Offences: Any  person that commit criminal  offence in Amawbia shall be a apprehended and hand over to /police for further necessary action.

 

ARTICLE 17:     APPOINTMENT OF COMMITTEES

Special Ad-hoc or standing Committees may be appointed the central Council of Amawbia Youth Vanguard to perform special legimate function or functions arising from time to time. As may be directed Any such committee can be recommended to dissolution by the central Youth council whenever deemed necessary.

 

ARTICLE 18:     STANDING ORDER/AGENDA

The General Assemble shall be conducted with a standing order prepare by the Central Youth Council.

 

ARTICLE 19:     VOTING ON MOTIONS

Voting on motions at both CENTRAL Youth Council meeting and General Assemble shall be by  secret ballot or show of hands as may be determined by a simple majority or those holding the meeting. Where there is a tie, the (chairman) or whoever acts for him shall have a casting  vote.

 

ARTICLE 20:     MEMBERS RIGHTS, RIGHTS &

RESPONSIBILITIES

  • Each village delegate of Amawbia Youth Vanguard should have the right to full and free participation in the administration of the Amawbia Youth Vanguard.
    • To vote and be voted for, as provided in the constitution of the Amawbia Youth Vanguard.
    • To express views as to the method in which the affairs of the Amawbia Youth Vanguard should be conducted.

 

  • Each member is entitled to a fair treatment in the application of the rules and constitution of the Amawbia Youth Vanguard.

 

  • The right of an individual member to criticize the polices of the Amawbia Youth Vanguard and its officers does not include the right to undermine the progress of the Amawbia Youth Vanguard or to slander or libel any of its officers.

 

  • Meeting should be periodically, as provided for in the rules and constitution of the Amawbia Youth Vanguard with proper notice of time and place. It should be the responsibility of the Central Youth Council to call such meeting, and of the members to attend and participate actively.

 

  • Sanctions for breaches of the rules should be fines, suspensions or termination of membership. The amount of fine or penalty shall be at the discretion of the Chairman, Central Youth Council or General Assemble depending on the gravity of the offence, and the severity of the punishment. The General Assemble is the final arbiter.

 

ARTICLE 21:     RESPONSIBILITIES OF THE ELECTED AND APPOINTED OFFICERS OF THE AMAWBIA YOUTH VANGUARD

 

All officers of the Amawbia Youth Vanguard shall:-

  • Uphold the constitution of the Amawbia Youth Vanguard and equally that of Amawbia Town Union.

 

  • Render honest, impartial and efficient services to the Amawbia Youth Vanguard.

 

  • Serve as an effective link between the Amawbia Youth Vanguard and its members.

 

  • Obey all lawful instructions in the discharge of Amawbia Youth Vanguard functions.

 

  • Eschew all forms of selfish individualisms which are inimical to solidarity, stability and progress of the Amawbia Youth Vanguard and Amawbia Town.

 

  • Render true account of his stewardship to the members of the Amawbia Youth Vanguard as and when occasion demands.

 

  • Abide by majority decisions and respect the rights of majority.

 

ARTICLE 22:     BENEFITS

The Amawbia Youth Vanguard shall provide for life and death benefits to its members.

 

(1)     LIFE BENEFIT

Any member holding any function and invites the Amawbia Youth Vanguard shall be given N1,000.00 through a delegation to be appointed by the Central Youth Council to represent the Amawbia Vanguard.

 

(2)     DEATH BENEFIT

When a member whose name is registered with Amawbia Youth Vanguard die, the family will receive the sum of N2,000.00 provided the Amawbia Youth Vanguard is informed properly about the death and invited to the funeral ceremonies.

 

A funeral levy of N20,per member shall be collected immediately to finance the Death Benefit. During functions like (1) and (2) paper shall be passed round for the compilation of personal donations and gifts. The list and the individual donations/gifts should be used during that particular occasion.

 

(3)     CAVET

To qualify for any of the benefits outline herein, member must have cleared all their debts to the Amawbia Youth Vanguard.

 

(4)     OTHER BENEFITS

The Central Youth Council may consider and grant any requests for other benefits or assistance according to the merits of such requests. Any benefits or assistance so granted shall constitute a precedence for future cases.

 

(5)     RECEPTION PROTOCOL

Members inviting the Amawbia Youth Vanguard to their functions shall accord the Amawbia Youth Vanguard’s delegates and their entourage honourable/befitting reception like reserve seats in a designated vantage area/pavilion canopy.

 

 

ARTICLE 23:     DISSOLUTION OF THE AMAWBIA YOUTH

VANGUARD

 

The Amawbia Youth Vanguard shall be dissolved as a result of:

(i)       Where there is properly fitted motion for dissolution by a member and receive 2/3 majority vote from at least four villages in a General Assemble or any special General Meeting, but must be approved by ATU.

 

(ii)      Where by any Government act, or edict.

 

(iii)     Amawbia Town Union may at any time dissolve the Executives of Amawbia Youth Vanguard or suspend its activities. If it considers its fit in the interest of peace and unity of Amawbia of if it finds the Vanguard engaging in activities detrimently to good governance and stability of the Amawbia Town.

 

(iv)     Where as a result of any civil disturbance or any unavoidable circumstances, the assets and liabilities of the Amawbia Youth Vanguard shall be taken by the Trustees of Amawbia Youth Vanguard for management. Where the Amawbia Youth Vanguard is not reconstituted for whatever reason(s), the Trustees shall discharge the liabilities legally and hand over the assets to the Amawbia Town Union through the Central Council, Amawbia Town Union.

 

ARTICLE 24 – GENERAL

We the entire Amawbia Youth Vanguard in Amawbia Town have voluntarily resolved the come together as one entity in Amawbia to form a grouping to be known as Amawbia Youth Vanguard so as to promote love, unity and cooperation amongst all indigenes and non-indigenes of Amawbia Town and as well to ensure peaceful co-existence with all organization, companies, governmental agencies, okpaligwe of Amawbia and Amawbia Town Union in general.

 

We further resolve to achieve these objectives by operating the listed articles in this document. This document shall be known as the Constitution of Amawbia Youth Vanguard, Amawbia Town.

 

The Constitution shall be deemed to be the fundamental principles of the Amawbia Youth Vanguard binding all its members. No new rules shall be made or any rule alternation or amended without an agreement by a 2/3 majority vote at the General Assemble of the Amawbia Youth Vanguard approve by Central Council of the ATU.
